Description:
A 19-year-old man gunned down Thursday in St. Roch was a witness in a murder case that had been scheduled to go to trial earlier this month but was postponed because of Hurricane Gustav.
Darrick Jack died about 6 p.m. in the 2000 block of Franklin Avenue, shot several times in his chest, arm and back, according to police.
Almost two years ago, on Oct. 18, 2006, Jack witnessed the shooting death of Milton Marcelin, 26, not far from where he died Thursday. Jack had been walking down North Rocheblave Street, heading to the store on an errand for his mother, according to a police report about the Marcelin case.
As he walked in the 2000 block of North Rocheblave Street, Jack saw Kevin Harrison, 22, confront Marcelin outside a FEMA trailer next to 2050 N. Rocheblave, the report said. Harrison demanded money he believed he was owed, according to the report.
Marcelin responded, "I ain't giving you any money, " according to the report. Harrison then pulled out a gun, firing several times. Marcelin was shot in his head and torso. Eight spent .40 caliber casings were found at the crime scene.
Jack quickly walked past the shooting scene and went to the Richards Food Store on the corner, he later told police. When he left the store, Harrison was waiting for him outside.
Harrison told him, "If you say something, you're gonna be next, " Jack told police.
When interviewed by police in January 2007, Jack could not identify Harrison by name, saying he knew him as "Christopher." But he picked Harrison out of a photograph lineup and identified him as the killer in court during a preliminary hearing in April 2007, according to the court records.
The second-degree murder case against Harrison was supposed to go to trial Sept. 2, but was postponed because of Hurricane Gustav, which hit the day before.
A spokeswoman for Orleans Parish District Attorney Robert Freeman said the office could not comment about any aspect of the case because it is pending in court. Officer Garry Flot, a spokesman for the New Orleans Police Department, said the motive behind Jack's shooting is under investigation.
